1. Acceptance of Terms

By accessing or using the Rad.FM service ("Service"), website, mobile application, or any related services provided by Rad.FM ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Service.

These Terms include a 14-day right to cancel, how subscriptions renew, and how to reach us. Please read section 8 before subscribing.

2. Description of Service

Rad.FM is an AI-powered DJ service that provides personalized music experiences, recommendations, and interactive features. Our Service includes:

• AI DJ host "Rad" with conversational capabilities
• Personalized music curation and recommendations
• Integration with third-party music streaming services (Apple Music)
• Interactive features including voice commands and chat functionality
• News, weather, and entertainment content delivery

3. Eligibility and Registration

3.1 Age Requirements

• You must be at least 13 years old to use our Service
• Users between 13-17 must have parental consent
• By using the Service, you represent that you meet these age requirements

3.2 Account Registration

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• One account per person; no sharing of accounts

4. Acceptable Use Policy

4.1 Permitted Uses

You may use our Service for personal, non-commercial purposes in accordance with these Terms.

4.2 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal, harmful, or unauthorized purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or attempt to extract source code
• Upload, transmit, or distribute malicious software or harmful content
• Harass, abuse, or harm other users or our AI systems
• Impersonate any person or entity or misrepresent your affiliation
• Collect or store personal data of other users without consent
• Use the Service to send spam or unsolicited communications
• Violate any applicable laws, regulations, or third-party rights

5. Intellectual Property Rights

5.1 Our Intellectual Property

• The Service, including all software, content, trademarks, and technology, is owned by us or our licensors
• You receive a limited, non-exclusive, non-transferable license to use the Service
• This license does not grant you any ownership rights in our intellectual property

5.2 User Content

• You retain ownership of content you create or upload ("User Content")
• By submitting User Content, you grant us a worldwide, royalty-free license to use, modify, and distribute it in connection with the Service
• You represent that you have all necessary rights to grant this license
• We may remove User Content that violates these Terms

5.3 We do not train on your data

• We do not use your interactions with Rad to train AI models
• We may count aggregate usage to understand which features are used, in a form that does not identify you
• Rad is a fictional presenter. What he says is generated, and is not the opinion of a person

6. Third-Party Services

6.1 Music Streaming Integration

• Our Service integrates with Apple Music and other third-party services
• You must comply with the terms of service of these third-party providers
• We are not responsible for the availability, content, or practices of third-party services
• Valid subscriptions to third-party services may be required

6.2 Third-Party Links

• Our Service may contain links to third-party websites or services
• We do not endorse or assume responsibility for third-party content
• Your use of third-party services is at your own risk

7. Privacy and Data Protection

• Our collection and use of personal information is governed by our Privacy Policy
• By using the Service, you consent to our data practices as described in the Privacy Policy
• We implement appropriate security measures to protect your data
• You acknowledge that no data transmission over the internet is 100% secure

8. Payment Terms and Subscriptions

8.1 Premium Features

• Certain features may require payment ("Premium Features")
• Subscription fees are charged in advance. Consumers in the EU and UK have the 14-day right to cancel set out in 8.3
• We may change pricing with 30 days' notice to existing subscribers

8.2 Auto-Renewal

• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel at any time: in the Rad.FM app under Settings, or through Apple if you subscribed on iPhone, or by emailing us
• Cancellation takes effect at the end of the current billing period

8.3 Your 14-day right to cancel

If you are a consumer in the EU or the UK, you have 14 days from the day you subscribe to change your mind and get a full refund, without giving a reason.

• To cancel, email us and say you want to cancel. A sentence is enough.
• We refund within 14 days of being told, using the same payment method.
• Rad+ starts immediately, so by subscribing you ask us to begin during the 14 days. If you then cancel, we may keep a proportion of the fee for the days you used.
• This right is in addition to cancelling at any time under 8.2, and nothing here limits your statutory rights.

8.4 Refunds

• Refunds are provided only as required by applicable law
• We may provide refunds at our sole discretion for exceptional circumstances
• Refund requests must be submitted within 30 days of purchase

9. Disclaimers and Limitations of Liability

9.1 Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties regarding uninterrupted or error-free operation
• Warranties regarding security or protection from harmful components

9.2 AI Content Disclaimer

• AI-generated content is provided for entertainment and informational purposes only
• AI responses may contain errors, inaccuracies, or inappropriate content
• We do not endorse or guarantee the accuracy of AI-generated content
• AI content should not be relied upon for professional, medical, legal, or financial advice

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Damages arising from third-party content or services
• Damages exceeding the amount paid by you for the Service in the 12 months preceding the claim

9.4 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions.

10. Indemnification

You agree to indemnify, defend, and hold harmless Rad.FM, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service or violation of these Terms
• Your User Content or any content you submit
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations
• Any claims that your use of the Service caused damage to a third party

11. Termination

11.1 Termination by You

• You may terminate your account at any time by contacting us or using account settings
• Termination does not entitle you to a refund of any fees paid

11.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, for:

• Violation of these Terms or our policies
• Suspected fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security reasons
• Discontinuation of the Service

11.3 Effect of Termination

• Upon termination, your right to use the Service ceases immediately
• We may delete your account and data, subject to legal retention requirements
• Provisions regarding intellectual property, disclaimers, and limitations of liability survive termination

12. Resolving a Dispute

If something goes wrong, contact us first. Most problems are settled faster by email than by anyone’s legal process, and we would rather fix it.

12.1 Your right to go to court

Nothing in these Terms takes away your right to bring a claim in court. If you are a consumer in the EU or the UK, you may bring proceedings in the courts of the country where you live, and you keep every right your local consumer law gives you.

12.2 Online dispute resolution

Consumers in the EU may also use the European Commission’s Online Dispute Resolution platform, and consumers anywhere may refer a complaint to their national consumer protection body.

13. Governing Law and Jurisdiction

• These Terms are governed by the laws of Ireland, without regard to conflict of law principles
• For disputes not subject to arbitration, the exclusive jurisdiction is the courts of Ireland
• You consent to the personal jurisdiction of these courts

14. International Users

• The Service is operated from Ireland (EU) and may not be available in all countries
• If you access the Service from outside Ireland, you are responsible for compliance with local laws
• We make no representation that the Service is appropriate or available for use in all locations

15. Modifications to Terms

• We may modify these Terms at any time by posting the updated Terms on our website
• Material changes will be notified via email or prominent notice in the Service
• Continued use of the Service after changes constitutes acceptance of the modified Terms
• If you do not agree to the changes, you must stop using the Service

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the original intent.

17. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by us.

18. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Rad.FM regarding the Service and supersede all prior agreements and understandings.

19. Assignment

• You may not assign or transfer these Terms or your account without our written consent
• We may assign these Terms and your account to any affiliate or successor entity
• These Terms bind and benefit the parties and their respective successors and assigns

21. DMCA and Copyright Policy

21.1 Copyright Infringement Claims

We respect intellectual property rights and respond to valid DMCA takedown notices. To file a copyright infringement claim, provide:

• Physical or electronic signature of the copyright owner or authorized agent
• Description of the copyrighted work claimed to be infringed
• Location of the allegedly infringing material on our Service
• Your contact information (address, phone, email)
• Statement of good faith belief that use is not authorized
• Statement that the information is accurate and you are authorized to act

21.2 Repeat Infringer Policy

We will terminate accounts of users who are repeat copyright infringers.
